Welcome to TOPPING Home Web (the “Service” or “Web Service”), provided by Guangzhou TOPPING Technology Co., Ltd. (“TOPPING”, “we”, “us”, or “our”). By accessing, registering for, logging into, or using the Service, you acknowledge that you have read, understood, and agree to be bound by this TOPPING Home Web User Agreement (the “Agreement”), our Privacy Policy, community rules, and other rules published for the Service.
If you do not agree to any part of this Agreement, please stop accessing or using the Service immediately. Users under 18 years old should read this Agreement with a legal guardian and use the Service only with the guardian’s consent.
TOPPING Home Web is a browser-based service for users of TOPPING audio devices, audio enthusiasts, and professional users. Depending on your browser, device, account status, region, and product availability, the Service may include one or more of the following features:
We may add, adjust, suspend, or discontinue parts of the Service based on product plans, device compatibility, browser capabilities, legal requirements, or security needs.
You may need to register or log in to use full features such as cloud PEQ, community interactions, profile management, avatar uploads, comments, favorites, likes, and publishing. You must provide true, accurate, complete, and up-to-date information during registration and use.
You are responsible for safeguarding your account, password, verification codes, access tokens, and device environment. You must not transfer, rent, lend, or otherwise provide your account to any third party. Unless you can prove otherwise, activities performed under your account will be deemed your actions. Please contact us promptly if you discover unauthorized access, abnormal login activity, or security vulnerabilities.
Device connection features depend on browser and operating system support, such as WebHID in the latest versions of Google Chrome or Microsoft Edge. When using device connection, firmware update, or local firmware assistant features, you may need to actively authorize browser access to USB/HID devices, download or run a local assistant, and allow local network or local-port communication.
By connecting a device, you authorize this website to access the TOPPING device you select in the browser permission prompt and, while you use the relevant features, to read device status, device information, and current configurations, send control commands to the device, and save configurations related to that device locally or in the cloud. Such control commands may include, but are not limited to, volume, input/output, PCM/DSD filters, output level, polarity, Bluetooth audio, APTX, remote control, auto power, display brightness, PEQ on/off, PEQ parameter writing, configuration synchronization, and firmware-update-related commands.
You may withdraw future access by managing browser permissions, disconnecting the device, clearing site data, or stopping use of the relevant features. After withdrawal, device connection, control, synchronization, firmware update, and local binding features may no longer be available.
You understand and agree that different browsers, operating systems, drivers, cables, USB hubs, and device firmware versions may affect connection capability, available functions, and update results. Please follow on-screen instructions and official guidance carefully, and avoid disconnecting devices, closing pages, cutting power, or forcibly terminating the local assistant during device writes, synchronization, or firmware updates.
Content that you create, upload, publish, or share through the Service includes, but is not limited to, PEQ configurations, preset titles, descriptions, headphone model information, comments, avatars, nicknames, profile information, and share-code-related content (“User Content”). You must ensure that your User Content does not violate laws or regulations and does not infringe any third party’s intellectual property, reputation, privacy, trade secrets, or other lawful rights.
When you publicly publish PEQ presets, comments, or profile information in the community/configuration center, such content may be viewed, searched, liked, favorited, commented on, downloaded, used, or forwarded by other users. You grant us a worldwide, non-exclusive, royalty-free license to store, copy, display, distribute, transmit, process, back up, review, operate, optimize, and promote your User Content for the purpose of providing and improving the Service.
We may hide, delete, restrict distribution of, unpublish, limit account functions for, or suspend accounts associated with content that is suspected to be unlawful, infringing, rule-violating, inappropriate, or harmful to service security or community order.
When using the Service, you must not:
PEQ adjustments, volume control, device parameter writes, cloud synchronization, and firmware updates may affect audio output, device status, or user experience. You should test at a reasonable volume and use high-gain, extreme-frequency, or large equalization adjustments carefully to avoid discomfort, audio distortion, or device abnormalities.
Firmware updates involve risks. To the extent permitted by law, we are not liable beyond mandatory legal obligations for update failures, device abnormalities, or data loss caused by power loss, disconnection, browser crashes, local assistant errors, driver issues, third-party system environments, user error, or unofficial firmware. Please back up important configurations by yourself.
All intellectual property rights in the Service and its text, images, icons, interfaces, interaction design, code, algorithms, device protocol implementation, brand marks, trademarks, documentation, and other content belong to us or the relevant rights holders. Without written permission from us or the relevant rights holder, you may not copy, modify, publish, distribute, rent, sell, reverse engineer, or use them for any unauthorized commercial purpose.
You retain rights you lawfully own in your original User Content, but you must ensure that you have the right to grant the license described in this Agreement.
The Service may invoke or link to third-party services, such as browser vendor capabilities, object storage, email or SMS services, cloud services, firmware downloads, local update assistants, open-source libraries, or other technical services. Third-party services are provided by their respective providers and may be governed by their own terms and privacy policies. To the extent permitted by law, we are not responsible for the availability, accuracy, security, or policy changes of third-party services.
We value your privacy and personal information protection. We collect, use, store, share, and protect your personal information in accordance with the TOPPING Home Web Privacy Policy. By using the Service, you understand and agree that we process information related to the Service in accordance with that Privacy Policy.
We may update, suspend, interrupt, restrict, or terminate the Service for operational, security, compliance, device compatibility, system maintenance, feature iteration, force majeure, or other reasons. For planned maintenance, we will make reasonable efforts to provide appropriate notices.
If you violate this Agreement, related rules, or applicable laws or regulations, we may issue warnings, restrict functions, remove content, suspend or terminate your account, or refuse to continue providing the Service. You may also stop using the Service at any time. After termination, we will process your relevant data in accordance with applicable laws and the Privacy Policy.
The Service is provided on an “as is” and “as available” basis. To the extent permitted by law, we make no express or implied warranties that the Service will be uninterrupted, error-free, completely secure, always compatible with all browsers or devices, or meet all of your expectations.
You understand that Internet services, browser capabilities, WebHID, local assistants, device firmware, and third-party environments may be affected by many factors. To the extent permitted by law, we are not responsible for service unavailability, data loss, or device abnormalities caused by force majeure, network failures, system maintenance, third-party service issues, user error, or other causes beyond our reasonable control.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, business interruption, data loss, device abnormalities, hearing discomfort, third-party claims, or other intangible losses. If we are required by law to assume liability, our aggregate liability shall be limited to the greater of the total amount you actually paid for the relevant Service in the 12 months preceding the dispute or RMB 100, unless mandatory law provides otherwise.
We may update this Agreement based on product changes, laws and regulations, or operational needs. The updated Agreement will be posted on the website, in the application, or at another appropriate location and will take effect on the date of posting or the stated effective date. If you continue using the Service after the update, you will be deemed to have accepted the updated terms. If you do not agree, please stop using the Service.
The formation, validity, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People’s Republic of China. Disputes arising from this Agreement or the Service should first be resolved through friendly negotiation. If negotiation fails, both parties agree to submit the dispute to the competent people’s court at the location of the service provider.
